DOI Supplementary Notice on Pending and Registered Trademarks

On December 1, 2025, the Department of Industry ("DOI"), published a supplementary notice (“Notice”) in Gorkhapatra with regard to the pending and registered trademarks in Nepal.

DOI, in its notice dated August 19, 2025, had previously informed applicants with incomplete trademark applications to submit the outstanding documents, and those with uncollected registration certificates to remit the prescribed fee and obtain their certificates within ninety (90) days.

However, due to the incident of arson, vandalism, and looting that occurred nationwide on September 9, 2025, which resulted in the destruction of the physical records maintained by the Industrial Property Section of the DOI, the DOI subsequently suspended the notice issued on August 19, 2025.

Furthermore, on December 1, 2025, DOI published a Notice in reference to its earlier notice dated August 19, 2025.  The Notice requires the following actions from applicants who have filed applications for the registration of trademarks under the Patent, Design, and Trademark Act, 2022 (1965 A.D.) ("PDTA"):

  • Incomplete Applications: For applicants whose applications for trademark registration have not yet been published in the Industrial Property Bulletin on account of incomplete documentation are requested to resubmit their applications along with all outstanding documents to the DOI within ninety (90) days from the date of publication of the Notice i.e. March 1, 2026.  Failure to submit the required documents within the stipulated period shall result in automatic cancellation of all such applications pending at DOI for more than seven years from the date of publication of the Notice i.e., prior to December 1, 2018, upon expiry of the aforesaid ninety-days period.
     
  • Uncollected Certificates: Applicants whose applications have been published in IP Bulletin before the publication of Notice and against which no opposition was filed, must submit an application to the DOI along with the necessary documents to obtain the registration certificate within six months from the date of publication of the Notice i.e.  June 1, 2026.  Failure to obtain the certificate within the prescribed timeframe will result in the automatic cancellation of the application.
